Fraud in Arbitration: Evidence, Timing and Enforcement

Syed Rahman was one of the main speakers at a conference examining the effect that fraud can have on arbitration cases.

“Fraud in Arbitration: Evidence, Timing and Enforcement’’ was held from 4.30pm-6pm on June 4, 2026, at the offices of global consultants J.S. Held in St Swithin's Lane, London. It was part of London International Disputes Week.

Syed was part of a panel of speakers that included Sam Stainer, director at J.S Held, and Stephen Cogley KC and Elliott Cook, barristers at 4 Pump Court chambers.

Syed and his fellow panellists discussed how fraud affects proceedings when it is discovered at different stages of the arbitral process.

They examined three key scenarios: fraud uncovered during an arbitration, fraud raised as a ground to challenge an award, and fraud invoked at the enforcement stage. The discussion considered how tribunals and courts respond in each situation and whether timing alters the available remedies.

The panel also considered issues such as:

• the evidential threshold for proving fraud in arbitration
• when it is appropriate to allege fraud
• how fraud allegations shift the dynamics of disclosure, costs and case management
• the tension between arbitral confidentiality and the public interest, particularly in high-value cross-border disputes

This event brought together practitioners experienced in complex disputes and asset recovery. It provided practical insights into how fraud allegations reshape arbitration strategy and outcomes.
