Angelika Hellweger wrote about practical mechanisms of extended disclosure under Practice Direction 57AD in the Business and Property Courts.
Her analysis of the case of Irwell Riverside Developments Limited v Arcadis Consulting was requested by Lexis Nexis, which published her article. The case arose due to a dispute over the design of part of a construction project, valued at approximately £21 million.
Angelika explained that the case illustrates the duties under the latest rules and how to manage extended disclosure under PD 57AD. The case, she said, showed that a court will be reluctant to grant applications which might end in “fishing expeditions” and highlights the importance of cooperation between the parties.
