Angelika Hellweger was asked by Lexis Nexis to analyse the United States’ recently-passed Foreign Extortion Prevention Act (FEPA).
In her article, Angelika details the main aspects of FEPA. She also explains how it interacts with the US Foreign and Corrupt Practices Act (FCPA).
Angelika emphasises that FEPA broadens the scope and reach of US anti-bribery and corruption law by expanding bribery offences to include the “demand side” and by covering individuals that act in an unofficial capacity for agencies.
It is, she says,
another tool for US regulators to both start enforcement proceedings involving US interests and target foreign actors, regardless of where the alleged bribery was committed.
Her piece also outlines why it is important for UK lawyers and businesses to be aware of FEPA.
