Angelika Hellweger Explains how ESG-related Litigation is Developing

Lawyer Monthly published Angelika Hellweger’s assessment of the development of ESG-related litigation.

In her article, Angelika explains that more courts worldwide are issuing judgements in favour of protecting the climate. She cites the recent European Court of Human Rights (ECHR) case of Verein KlimaSeniorinnen Schweiz and outlines the significance of a number of other notable legal rulings.

Angelika says that the future of ESG litigation is “an intriguing proposition’’. The International Tribunal for the Law of the Sea recently confirmed that states are under a legal obligation to protect the oceans from climate change, and the outcomes are awaited of further requests for advisory opinions from the International Court of Justice and the Inter-American Court of Human Rights.

Angelika states that an increase in climate-related litigation against non-financial institutions and a more diverse range of corporate actors can be expected. She details possible grounds for such action and the difficulties that can be faced by those attempting to bring such cases.
