Angelika Hellweger explains the significance of a European Court of Human Rights ruling regarding climate change

The importance of the climate change case Verein Klima Seniorinnen Schweiz and Others v. Switzerland was outlined in an article by Angelika Hellweger.

In her piece, which was published by LexisNexis, she explains that the European Court of Human Rights (ECHR) case was brought by a non-governmental organisation representing elderly women and four individuals. 

The claimants argued that the Swiss government’s lack of action infringed upon their right to life (as guaranteed by Article 2 of the European Convention on Human Rights) and their right to respect for private and family life (Article 8 of the European Convention on Human Rights). 

The court ruled that Article 8 had been violated by Switzerland. Angelika details the court’s findings, the climate change obligations that countries have to meet and concludes that this case is a “wake-up call that carries significant implications for businesses’’.
