Commercial Crime International asked Angelika Hellweger for her assessment of the risks of corporate criminal liability for misuse of AI.
Angelika explained that, as yet, examples of such wrongdoing have yet to emerge in the UK. She said that corporates are, for now at least, on their own when it comes to assessing and managing liability risks when producing and using AI tools.
Given the absence of a legal framework that deals with the criminal liability of AI, Angelika detailed other legal avenues that lawyers and law enforcement could consider to secure accountability.
She also emphasised that as the types of crime that AI may be used for may be “traditional’’ in nature – such as theft, extortion, intimidation and fraud - many existing UK laws can be applied without there being any need for AI-specific laws.
