The Times sought Aziz Rahman’s assessment of the Serious Fraud Office’s latest guidance for corporates.
The guidance states that corporates that self-report wrongdoing and cooperate with the SFO can expect to be offered a deferred prosecution agreement rather than be prosecuted.
Aziz told The Times: “The SFO may not be rolling out the red carpet for those thinking of self-reporting wrongdoing. But it is certainly letting them know that the door is always open.’’
He said the guidance offers greater certainty to those reporting wrongdoing and will be viewed by many in business as a “welcome invitation … to come and talk things over”.
He added: “The prospect of facing a DPA for self-reporting rather than prosecution amounts to the SFO dangling a very enticing carrot in front of the corporate world in order to identify and address wrongdoing as efficiently as possible.”
