Rahman Ravelli has mounted a challenge to the validity of the European Arrest Warrant (EAW) scheme in the wake of Brexit.
The Firm’s Legal Director, Syed Rahman represents a hedge fund manager facing extradition to Germany as part of investigations into Cum-Ex trading. The manager has not been charged with any crime. This is the first case to test post Brexit extradition relations with the EU
On 15th January 2021 the Divisional Court heard submissions that the extradition request relating to his client is now invalid because the UK is no longer part of the EAW programme, as the Brexit transition period ended on January 1. As a result, the legal team argued, there is no longer any power to extradite anyone under the 2003 Extradition Act.
