UK law enforcement powers to seize crypto assets in criminal prosecutions and civil recovery proceedings were evaluated by Ulrich Schmidt.
In an article published by LexisNexis, he outlined the relevant powers given to UK law enforcement under the Economic Crime and Corporate Transparency Act 2023 and the legal recognition of crypto assets as property.
Ulrich detailed how the authorities can identify and seize wallets for investigation and later forfeiture. His piece also considers the limits of compulsory powers, especially where the crypto assets are held in non-custodial wallets.
