Syed Rahman assesses the likelihood of failure to prevent fraud prosecutions

With the corporate offence of failure to prevent fraud coming into effect this year, Syed Rahman considered the prospects for successful prosecutions.

In an article published by Law360, he explains the scope of the new offence and the Labour Party’s position in recent years on corporate criminal liability.

Syed details the main points of the Economic Crime and Corporate Transparency Act 2023, which the failure to prevent fraud offence is part of, and examines some of the key corporate criminal liability legislative initiatives.

He concludes that “the current corporate crime architecture for fraud and corruption is a patchwork of legislation that has not been, and likely will not be, successful in assisting prosecutors bring companies to justice.’’
