With Jonathan Fisher KC having published his recommendations following a review of the UK’s disclosure and fraud offences, GIR asked Rahman Ravelli for their thoughts.
Rahman Ravelli said that the recommendation that prosecution agencies should review any cases where convictions are thrown out on appeal due to disclosure failures could be beneficial. They explained that such reviews would help mitigate the possibility of mistakes being repeated.
Rahman Ravelli agreed with Fisher KC’s view that there was no need to introduce sanctions for parties that make errors in the disclosure process, as the powers judges already have to deal with such failures are sufficient.
They added: “Given the disclosure concerns more recently in fraud cases, one would hope that there is already a culture shift amongst prosecutors and law enforcement generally as to how they discharge their disclosure duties.”
Rahman Ravelli emphasised that Fisher’s recommendations were just that.
“What is most important now is exactly which, if any, of these recommendations are adopted, and how swiftly they can be put into action,” they said.
