In his article, which was published by Lexis Nexis, Niall details how hundreds of sub-postmasters were wrongly prosecuted over allegations of false accounting, theft and fraud that were actually due to faults in the Post Office’s Horizon accounting software system.
Niall outlines why the Crown Prosecution Service (CPS) did not manage the prosecutions. He says that the case shows that more safeguards may be necessary, particularly regarding whether an organisation such as the Post Office should act as prosecutor when it is also the alleged victim and the investigator.
His piece also considers what private prosecutors can learn from the case and how the government may resolve all the outstanding appeals against conviction.
