Rahman Ravelli highlight a ruling that emphasises the need for authorities to check facts when imposing sanctions

Rahman Ravelli wrote about a recent Court of Justice of the European Union ruling that annulled the designation of an individual on the grounds that the underlying facts were no longer accurate and up-to-date.

The article by Rahman Ravelli, which was published by Lexis Nexis PSL, detailed the facts of the case. It involved Dmitry Ovsyannikov, a former governor of Sevastopol, saying he should no longer be sanctioned as he had left the official positions he had held in Russian-occupied Crimea. He also argued that he was no longer involved in politics.

The Council of the European Union, which had kept Ovsyannikov on its list of sanctioned individuals, disputed his claims.

But the Court of Justice found in favour of Ovsyannikov. The Court stated there was an obligation on the Council to ensure that any information used to retain a person on a sanctions list remains valid.
