Syed Rahman comments on proposals to overhaul the UK’s response to fraud

Rahman Ravelli Partner Syed Rahman has been quoted by Law360 in its analysis of Jonathan Fisher KC’s recommendations for reforming the way fraud is detected, prevented and prosecuted in the UK.

The review proposes a wide-ranging package of reforms, including deferred prosecution agreements for individuals, financial rewards for whistleblowers, tougher sentences for serious fraud and new responsibilities for technology platforms whose services are used to facilitate scams.

It also recommends introducing a levy on digital and communications providers, with the proceeds used to support law enforcement and fraud-detection technology.

Commenting on the proposals, Syed said:

“The recommendations acknowledge a long-recognised reality that, while digital fraud has evolved rapidly, the legal framework for enforcement remains largely analogue.

“The real test will not be whether the government accepts these recommendations, but whether it is prepared to fund the changes required. That will include investment in technology and a more efficient approach to managing the growing volume of digital evidence.”

Syed’s comments reflect the practical challenges facing investigators and prosecutors as they deal with increasingly complex fraud cases involving substantial volumes of digital material.
