Ruxandra Murariu outlines the implications of the new failure to prevent fraud offence

With the new corporate offence of failure to prevent fraud coming into force next year, Ruxandra Murariu outlined what companies need to know about it.

In her piece, which was published by LexisNexis, she explains that the offence aims to hold large organisations to account for fraud committed by their employees, agents, subsidiaries or other persons who provide services for or on behalf of the organisation, where the fraud was committed with the intention of benefiting the organisation or the organisation’s clients. 

Ruxandra cites examples of conduct that may be covered by the offence, detail the reasonable procedures defence that is available and summarise the guidance the government has issued about it.

She considers whether the offence will mean an increase in enforcement activity and emphasise the need for companies to ensure they are prepared for its arrival.
