Rahman Ravelli was asked by Dow Jones Risk Journal for their thoughts on proposals in the UK Treasury’s review of financial sanctions enforcement.
The initial review proposes changes to the Office of Financial Sanctions Implementation’s (OFSI’s) civil enforcement processes.
They explained the possible benefits of a proposal to introduce a settlement scheme that would allow subjects to resolve enforcement actions through negotiated agreements rather than going through the full investigation process.
They said this would be a welcome step as - apart from HM Revenue and Customs’ compound penalty powers - the UK currently lacks early settlement mechanisms for sanctions violations.
They added: “The scheme should, in principle, lead to speedier resolutions for subjects of OFSI investigations, while also offering legal protection, should settlement discussions break down.’’
